2020 5/11/2020 8 Procedural General Order Regarding Requests for Compassionate Release REQUESTS FOR COMPASSIONATE RELEASE 2018 FIRST STEP ACT, SECTION 603 18 U.S.C. § 3582(c)(1)(A) UNITED STATES DISTRICT COURT MIDDLE DISTRICT OF LOUISIANA IN RE: REQUESTS FOR GENERAL ORDER COMPASSIONATE RELEASE NO. 2020-8 2018 FIRST STEP ACT, SECTION 603 18 U.S.C. § 3582(c)(1)(A) PROCEDURAL GENERAL ORDER REGARDING REQUESTS FOR COMPASSIONATE RELEASE On December 21, 2018, the President signed into law the First Step Act of 2018, Pub. L. No 115-391, 132 Stat. 5194 (2018). This legislation provides grounds for certain defendants sentenced by this Court to seek relief from their sentences. Pursuant to the provisions of the Criminal Justice Act, 18 U.S.C. § 3006A(a)(1) and (c), and in order to efficiently process motions and petitions raising potential claims for relief under Section 603 (compassionate release) of the 2018 First Step Act, codified under Title 18 U.S.C. § 3582(c)(1)(A), any such motions filed pro seby a defendant previously determined to have been entitled to appointment of counsel and any defendant who is now indigent are referred to the Office of the Federal Public Defender (FPD) for the Middle District of Louisiana for screening purposes to determine whether that defendant may qualify for relief under Section 603 of the First Step Act (18 U.S.C. § 3582(c)(1)(A)), and in appropriate cases, to enroll and present any petitions, motions, or applications to the Court for disposition. The FPD shall have District Court USPO FPD US Attorney fifteen (15) days to screen such matters and file a motion to enroll as counsel or to request appointment of counsel from the Criminal Justice Act panel in the case of a prohibitive conflict that would prevent FPD representation of a client or other good cause supports appointment of outside counsel. If the FPD, a CJA Panel Attorney, or anylicensedand admitted attorney files a motion to enroll for purposes of representation under these Compassionate Release provisions,the United States Attorney's Office shall be notified. In all cases where the FPD or CJA Panel enrolls, counsel for the movant shall confer in good faith with counsel for the Government within fifteen (15) days of enrolling. Counselfor the defendant shallhave thirty (30)days from the date of enrollment to fileanysupplemental briefing in support of the request for relief. The Government shall have fifteen (15) days from the filing of the defendant's supplemental brief to filea response. For the purpose of determining the defendant’s eligibility for relief under compassionate release provisions of the First Step Act, the United States Probation Office is authorized to disclose the most recent and relevant documents, including but not limited to, Presentence Investigation Reports or Modified Presentence Investigation Reports, and Statements of Reasons, to the FPD, CJA panel members, retained counsel, and the United States Attorney's Office. If, after expiration of the fifteen (15) day screening period by the FPD a motion to enroll is not filed, the defendant will proceed pro se and the Court will thereafter review and rule on any pending Compassionate Release matters and issue any necessary orders. 2020 3/16/2020 1 AO 2020-1: Court Operations Curtailed During COVID-19 Outbreak This Order is being issued in response to the COVID-19 virus (coronavirus) outbreak in Louisiana. On March 11, 2020, the Governor of the State of Louisiana declared a State of Emergency. On March 13, 2020 the President of the United States declared a National Emergency. The World Health Organization has declared the COVID19 outbreak a pandemic. The Centers for Disease Control and Prevention ("CDC") has described the outbreak in the United States as a "rapidly evolving situation" and is providing continuous guidance regarding appropriate public and private responses to COVID-19. The CDC's guidance includes multiple types of mitigation strategies, including but not limited to social distancing, as well as other strategies generally aimed at reducing or avoiding exposure to infected individuals which the Court has carefully considered. To combat the spread of the disease, given the severity of risk posed to the public, court staff, and other court agencies, and considering the CDC’s advisements to take precautions by limiting exposure to the virus, the Middle District of Louisiana will enforce the following protocol effective March 16, 2020 730 3

2018 8/17/2018 15 In Re: Media Access August 16, 2018 - Access to the Media; type of devices allowed. lNRE: MEDIA ACCESS UNITED ST A TES DISTRICT COURT MIDDLE DISTRICT OF LOUISIANA ORDER GENERAL ORDER No. 2018- 1 Effective August 1, 2018, the Court will allow credentialed members of the media to bring the following electronic devices into the Courthouse and Courtrooms: laptops with silent keyboards, tablets, and smart phones ("electronic devices"). In order to be considered a credentialed member of the media, an individual who is either employed by a news agency or is self-employed must submit an application for a Media Identification Card and, subsequently, be approved for said Media Identification Card. The Court reserves the right to perform a background check and due diligence examination on issues that would bear directly on the subject matter at hand for each applicant for a Media Identification Card. Should either result in the rejection of credentials, the applicant will be given the opportunity to discuss the reasons for said rejection with the Coutt's Media Liaison, in an effort to determine if a reversal of the rejection is necessary. The Clerk of Court shall maintain the list of all eligible credentialed members of the media and shall provide said list to the United States Marshal's Service and Court Security Officers for use during building entry screening. All credentialed media members shall wear their Court-issued Media Identification card upon entry and throughout their duration in the Courthouse. Nonverbal use of electronic devices shall be permitted, provided they are silent and do not create any disturbances. The presiding Judge in the coLuiroom is authorized to determine whether 2 use of an electronic device is disruptive to the proceeding at hand and to direct its discontinuance if found to be disruptive. Violation of this Administrative Order and/or related Local Rules 83( c )(9) and 83( c )(10) will require the immediate deletion of the offending material from the media member's device. Furthermore, any such violations will result in the suspension and/or revocation of the credentialed media member's Court-issued Media Identification Card. Ultimately, the Chief Judge shall have the discretion to issue the appropriate sanction for said violations.
